REQUEST FOR THE RESTITUTION OF FREEDOM
FOR DR. CU HUY HA VU

My name is Nguyễn Thị Dương Hà. I was born on June 01, 1958, bearer of People’s ID No. 010538534 issued on May 9, 2000 by the Hanoi Police. My permanent residence is No. 22, Thanh Niên Road, Yên Phụ Ward, Tây Hồ District, Hanoi, and I am presently living at No 24, Điện Biên Phủ Blvd, Ba Đình District, City of Hanoi. I am the wife of Dr. Cù Huy Hà Vũ who was born on December 2, 1957. With respectful salutations, I would like to convey to you the following request.

My husband, Dr. Cù Huy Hà Vũ was arrested on November 5, 2010 and sentenced to 7 years of imprisonment and 3 years of surveillance, being charged with “disseminating information deemed hostile to the State of the Socialist Republic of Vietnam”.
He is presently imprisoned in Detention Camp No. 05 of the Public Security Ministry.

I learn that on November 1, 2011, the United Nations’ Working Group on Arbitrary Detention sent a communication to the government ofVietnamin which it construed the detention of Dr. Cù Huy Hà Vũ as clearly devoid of due process. This unfortunate action clearly contravenes Articles 9 and 19 of the International Covenant on Civil and Political Rights to whichVietnam– an official member of the United Nations since September 20, 1977 — is a party.
By the same token, the UN Working group did also ask the SRVN government to remedy the situation by immediately releasing Dr. Vu on the very first anniversary of his groundless detention on November 5, 2011 and according him an enforceable right to compensation as stipulated by Article 9(5) of the same Covenant.

This, then, represents the officially formulated opinion and request of the United Nations itself. So far, however, my husband has remained in custody of the State.

My question is whether or not the above-referenced UN action has enforceable legal validity, and if so, how and when it could be carried out as a matter of fact.

I am eagerly looking forward to hearing from you regarding this case.
